1. Scope of Agreement
These Terms and Conditions (“Terms”) govern the sale of the Calm Quest Pro Hardware Bundle, consisting of:
- One virtual reality headset (Meta Quest 3 / 3S or Pico 4 Ultra)
- One Coospo HW9 heart rate sensor (or equivalent or better alternative)
- A license for Calm Quest Pro software, with 2 months of unlimited usage included
2. Hardware Ownership and Third-Party Accounts
- Ownership of the physical hardware transfers to the Buyer upon delivery.
- The VR headset is manufactured and licensed by Meta Platforms, Inc. or Pico Interactive, respectively. The Buyer must create and maintain their own Meta or Pico user account, subject to the manufacturer’s own terms and conditions.
- Acute XR does not transfer, sublicense, or guarantee any Meta or Pico account or software rights. Buyer is solely responsible for compliance with third-party license terms.
3. Calm Quest Pro Software License
- The bundle includes a 2-month unlimited usage license for Calm Quest Pro, beginning on the date of activation.
- Continued use after the 2-month period requires purchase of a separate subscription.
- Use of Calm Quest Pro is governed by the End User License Agreement (EULA) displayed in the Acute XR Launcher. The Buyer must accept the EULA to activate and use the software.
4. Delivery and Setup
- Hardware will be shipped after purchase and remains at risk of the Buyer once delivered.
- Buyer is responsible for device setup, account registration, and pairing of the heart rate sensor.
5. Returns and Warranty
- Returns of unopened bundles may be accepted within 14 days of delivery, subject to inspection.
- Hardware warranty is provided directly by the manufacturer (Meta or Pico, Coospo). Acute XR assumes no responsibility for manufacturer defects or warranty services.
- Calm Quest Pro software is provided “as is,” subject to the EULA.
6. Limitations of Liability
- Acute XR disclaims any liability for issues arising from third-party hardware or account services.
- Acute XR is not responsible for any loss of access to Meta/Pico services caused by changes in their terms or enforcement actions.
- Maximum liability of Acute XR under these Terms shall not exceed the purchase price of the bundle.
7. Governing Law and Jurisdiction
- These Terms are governed by the laws of Spain.
- Disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona.
8. Acceptance of Terms
By purchasing the Acute XR Bundle (via Stripe checkout or signed contract), the Buyer acknowledges and agrees to these Terms, and separately to the Calm Quest Pro EULA when activating the software.
